EXTRACT OF MINUTE OF MEETING OF EAST RENFREWSHIRE COUNCIL OF 19 NOVEMBER 2003

ADOPTION OF EAST RENFREWSHIRE LOCAL PLAN

Under reference to the Minute of meeting of 24 September 2003 (Page 251, Item 156 refers), there was submitted report by the Director of Environment, a copy of which had been issued previously to each Member, relative to the formal adoption of the East Renfrewshire Local Plan.

The report reminded Members that at the meeting on 24 September 2003, the Council had formally resolved to adopt the Local Plan on 1 November, provided that Scottish Ministers did not issue a Direction not to proceed to adoption. The required procedures associated with the notice of intention to adopt were carried out with effect from 2 October 2003. These included public advertisements in local papers, placing the Plan on deposit for public inspection, notification of interested parties, and sending a certified copy of the Plan to the Scottish Executive, with there being a 28 day period thereafter for the Scottish Ministers to consider whether or not to direct the Council not to proceed to adoption.

The report further explained that on 30 October 2003, a letter was received from the Scottish Executive directing the Council not to adopt the Local Plan until further notice, the reason given being that significant levels of correspondence had been received at the end of the 28 day period, and further time was needed to allow the Scottish Ministers to consider the representations that had been made. As a consequence, the Plan could not therefore be adopted in accordance with the decision taken earlier.

The report intimated that on 11 November 2003, further correspondence had been received from the Scottish Ministers indicating that they would be taking no further action and it was now possible for the Council to proceed to adoption of the Plan.

Having heard Councillors Hutchison and Lafferty commend officers in the Environment Department for their work throughout the entire local plan process, the Council:-

(a) resolved to adopt the East Renfrewshire Local Plan on 19 November 2003; and

(b) instructed the Director of Environment to carry out the relevant statutory notification procedures.
